On the 25.05.2021, the amendments to the Law on Planning and Construction (“Official Gazette of RS”, number 52/2021) came into effect.
Novelties
- New deadlines for acquiring the exploitation permit;
For all buildings with decisions on the exploitation permit i.e., decisions on the construction permit issued in accordance with previous regulations governing the matter of building construction (Laws in effect before the 11.09.2009) the new deadline for acquiring the exploitation permit according to the specified amendments is four (4) years, i.e., until the 25.05.2025.
- Final deadlines for the adoption of new planning documents defined;
The competent state authorities which have not yet done so are obligated to adopt new planning documents replacing those adopted before 1.1.1993., by no later than 24.5.2023. In the event of failure to comply with the specified deadlines, the responsible person will be fined between 50.000,00 and 150.000,00 Dinars.
Goals
The intention of the legislator is obvious; harmonization and legal regulation of the factual situation resulting in a smaller number of buildings that have not been issued an exploitation permit even though they have a construction permit, and an incentive for further comprehensive development of construction projects.
Also, starting with 12.7.2021, a new improved version of the Information system of the Central Registry of the Unified procedures (CEOP) for the submission of requests and issuing e-Construction permits went into operation.
Novelties:
- Electronic payment of taxes and fees through the e-payment system of eOffice (eUprava);
- Insight into the history of all payments throughout the duration of the unified procedure;
- eRequests for implementation of the finality clause;
- The option of changing the acting authorized representative with submittance of relevant documentation;
- Improved contents of all notifications and info fields with appropriate instructions;
- Automatic update of existing data upon new request (the data is automatically copied and aligned from the previously submitted request;
- Numerous other technical novelties.
Goals
The goal of the CEOP is simplified submittal of requests, data entry and case tracking in the process of unified procedure for the issuance of electronic construction permits. All interested persons can access the central information system through the website of the Business Registers Agency or by registering via the internet address: Registri/Građevinske dozvole.
Also, the Business Registers Agency offers customer support via electronic mail or by telephone, for all questions and additional information throughout the process of use of the new system version.
