An occupational disease represents a specific type of damage within an employment relationship that arises as a result of long-term exposure of an employee to harmful influences in the work environment. Unlike a workplace injury, an occupational disease often develops gradually, which makes proving the causal connection particularly complex.
Expert Examination and Causal Connection
In proceedings for compensation for damage caused by an occupational disease, experts in occupational medicine and forensic medicine play an important role. They provide opinions on the medical possibility and probability that a particular illness occurred as a consequence of specific work activities and working conditions.
However, the existence of a causal connection between the work performed and the resulting illness is a legal question decided by the court, based on a comprehensive assessment of all the evidence presented. In this process, the attorney plays a key role by linking the medical findings with the organization of work, workload, duration of exposure to harmful influences, and the chronological sequence of events.
Procedure for Determining an Occupational Disease
Which diseases are considered occupational, as well as the jobs and conditions under which they may occur, are regulated by the Rulebook on the Determination of Occupational Diseases. It should be noted that only illnesses explicitly listed in this rulebook can be recognized as occupational diseases.
The procedure for determining disability on the basis of an occupational disease is initiated by submitting a request to the competent branch of the Republic Fund for Pension and Disability Insurance. In this procedure, relevant medical records from healthcare institutions are used as evidence, including discharge summaries, specialist reports, results of diagnostic examinations, and laboratory analyses.
In addition to medical documentation, it is necessary to obtain an expert opinion from an authorized occupational medicine institution, such as the Institute of Occupational Medicine of Serbia “Dr. Dragomir Karajović,” the relevant occupational medicine institutions in Novi Sad and Niš, or the Institute of Occupational Medicine of the Military Medical Academy. These institutions provide expert assessments in accordance with the act regulating the determination of occupational diseases, which is of crucial importance in proving that the illness arose as a result of working conditions.
Importance of Legal Assistance
Proceedings related to occupational diseases are legally and evidentially complex, which is why professional assistance from an attorney is of key importance for properly conducting the procedure and protecting the rights of the insured person.
