About organization<\/strong><\/p>\n\n

The Serbian Film Authors’ Organization is a non-profit \norganization whose goal is the collective realization of \nproperty copyrights for film authors and other rights \nholders. UFUS AFA PROTECTION protects the rights of \nfilm (and television) authors: directors, screenwriters, \ncinematographers and authors of animated films on the \nbasis of the contract they have concluded with UFUS \nAFA PROTECTION or on the basis of the Law on \nCopyright and Related Rights (composers exercise their \nrights through SOKOJ).<\/p>\n\n

What rights does UFUS AFA PROTECTION protect?<\/strong><\/p>\n\n

The general rule is that no property copyright \nauthorization can be exercised without the permission of \nthe author. The author, or the copyright holder, has the \nabsolute, exclusive, erga omnes right to prohibit or allow \nothers to use his work<\/p>\n\n

Film authors are the owners of their \nworks, therefore they are authorized to allow or prohibit \nanyone from duplicating these works, showing them in \ncinemas, broadcasting, rebroadcasting, communicating in \npublic places, making them available interactively (video \non demand), etc. <\/p>\n\n

They can exercise their rights individually \nor collectively and this mostly depends on the very nature \nof certain forms of exploitation. <\/p>\n\n

Individual Realization of \nProperty Copyrights<\/strong><\/p>\n\n

Thus, the right to \nreproduction, cinematography, broadcasting and making \nthem available in an interactive way are exercised \nindividually, since in those situations it is relatively simple \nfor the rights holder and the user to enter into direct negotiations on the terms of use. <\/p>\n\n

Collective Realization of \nProperty Copyrights<\/strong><\/p>\n\n

However, certain \nproperty rights cannot be exercised individually, so they are \nexercised collectively. Such is the case with rebroadcasting. <\/p>\n\n

What is the rebroadcasting of film works?<\/strong><\/p>\n\n

Even though our \nlaw creates some confusion because it unnecessarily \ndistinguishes between rebroadcasting and cable \nrebroadcasting, rebroadcasting essentially represents any \nsimultaneous communication of a film work to the public \nin an unaltered and complete form by a person other than \nthe TV station that originally broadcasts the film work.<\/p>\n\n

In \npractice, rebroadcasting is done via cable system, IPTV, \nover-the-top services (OTT) or direct to home (DTH) \nservice.<\/p>\n\n

Why is it impossible to exercise the right to \nrebroadcast film works individually, in contrast to the right \nto screen or broadcast them in cinemas? <\/strong><\/p>\n\n

Well, because \noperators appear as beneficiaries of the right to rebroadcast \nfilm works, who simultaneously distribute a large number \nof television programs within which an even greater \nnumber of film works are broadcast.<\/p>\n\n

The operator is not \nfamiliar with the programming scheme of each channel it \ndistributes in its offer, thus, it has no knowledge of whose \nworks it is rebroadcasting, so it is not even able to obtain \nthe right to rebroadcast film works in a direct relationship \nwith the author or another rights holder. <\/p>\n\n

For this reason, \nour legislation stipulates the obligation to exercise the right \nto rebroadcast exclusively in an organization for the \ncollective exercise of copyright.<\/p>\n\n

Whose work does UFUS AFA PROTECTION protect?<\/strong><\/p>\n\n

Based on the law and the license of the Intellectual \nProperty Office, UFUS AFA PROTECTION is authorized \nto “prohibit or permit the rebroadcasting and cable \nrebroadcasting of film works” for all domestic and foreign \ncinematic works. <\/p>\n\n

Namely, there are three categories of \nauthors\/rights holders of film works, namely: – domestic \nauthors – members of UFUS AFA PROTECTION, – domestic \nauthors who are not members of UFUS AFA \nPROTECTION – and foreign authors.<\/p>\n\n

Domestic \nauthors – members of UFUS AFA PROTECTION<\/strong><\/p>\n\n

Domestic authors - \nmembers of UFUS AFA PROTECTION exclusively \nassigned their rights to UFUA AFA PROTECTION, with \nthe permission to conclude contracts with users of \ncopyright works (operators) on the non-exclusive \nassignment of those rights on their behalf. <\/p>\n\n

Domestic and foreign \nauthors who are not members<\/strong><\/p>\n\n

UFUS \nAFA PROTECTION protects the rights of both domestic \nand foreign authors who are not their members, given that \nthe legal assumption established in our law is that the \norganization has the authority to act on behalf of all \ndomestic and foreign copyright holders in regard to those \nrights and those types of subjects of protection that are \ncovered by their activity, i.e. their permit. <\/p>\n\n

This represents a \nso-called extended license, an institute which is generally \naccepted in the international regulation of collective \nprotection of copyright and related rights.<\/p>\n","protected":false},"excerpt":{"rendered":"
