UFUS AFA PROTECTION protects the rights of&#13;\nfilm (and television) authors: directors, screenwriters,&#13;\ncinematographers and authors of animated films on the&#13;\nbasis of the contract they have concluded with UFUS&#13;\nAFA PROTECTION or on the basis of the Law on&#13;\nCopyright and Related Rights (composers exercise their&#13;\nrights through SOKOJ).<\/p>\n\n<p><strong>What rights does UFUS AFA PROTECTION protect?<\/strong><\/p>\n\n<p>The general rule is that no property copyright&#13;\nauthorization can be exercised without the permission of&#13;\nthe author. The author, or the copyright holder, has the&#13;\nabsolute, exclusive, erga omnes right to prohibit or allow&#13;\nothers to use his work<\/p>\n\n<p>Film authors are the owners of their&#13;\nworks, therefore they are authorized to allow or prohibit&#13;\nanyone from duplicating these works, showing them in&#13;\ncinemas, broadcasting, rebroadcasting, communicating in&#13;\npublic places, making them available interactively (video&#13;\non demand), etc. <\/p>\n\n<p>They can exercise their rights individually&#13;\nor collectively and this mostly depends on the very nature&#13;\nof certain forms of exploitation. <\/p>\n\n<p><strong>Individual Realization of&#13;\nProperty Copyrights<\/strong><\/p>\n\n<p>Thus, the right to&#13;\nreproduction, cinematography, broadcasting and making&#13;\nthem available in an interactive way are exercised&#13;\nindividually, since in those situations it is relatively simple&#13;\nfor the rights holder and the user to enter into direct negotiations on the terms of use. <\/p>\n\n<p><strong>Collective Realization of&#13;\nProperty Copyrights<\/strong><\/p>\n\n<p>However, certain&#13;\nproperty rights cannot be exercised individually, so they are&#13;\nexercised collectively. Such is the case with rebroadcasting. <\/p>\n\n<p><strong>What is the rebroadcasting of film works?<\/strong><\/p>\n\n<p>Even though our&#13;\nlaw creates some confusion because it unnecessarily&#13;\ndistinguishes between rebroadcasting and cable&#13;\nrebroadcasting, rebroadcasting essentially represents any&#13;\nsimultaneous communication of a film work to the public&#13;\nin an unaltered and complete form by a person other than&#13;\nthe TV station that originally broadcasts the film work.<\/p>\n\n<p>In&#13;\npractice, rebroadcasting is done via cable system, IPTV,&#13;\nover-the-top services (OTT) or direct to home (DTH)&#13;\nservice.<\/p>\n\n<p><strong>Why is it impossible to exercise the right to&#13;\nrebroadcast film works individually, in contrast to the right&#13;\nto screen or broadcast them in cinemas? <\/strong><\/p>\n\n<p>Well, because&#13;\noperators appear as beneficiaries of the right to rebroadcast&#13;\nfilm works, who simultaneously distribute a large number&#13;\nof television programs within which an even greater&#13;\nnumber of film works are broadcast.<\/p>\n\n<p>The operator is not&#13;\nfamiliar with the programming scheme of each channel it&#13;\ndistributes in its offer, thus, it has no knowledge of whose&#13;\nworks it is rebroadcasting, so it is not even able to obtain&#13;\nthe right to rebroadcast film works in a direct relationship&#13;\nwith the author or another rights holder. <\/p>\n\n<p>For this reason,&#13;\nour legislation stipulates the obligation to exercise the right&#13;\nto rebroadcast exclusively in an organization for the&#13;\ncollective exercise of copyright.<\/p>\n\n<p><strong>Whose work does UFUS AFA PROTECTION protect?<\/strong><\/p>\n\n<p>Based on the law and the license of the Intellectual&#13;\nProperty Office, UFUS AFA PROTECTION is authorized&#13;\nto &#8220;prohibit or permit the rebroadcasting and cable&#13;\nrebroadcasting of film works&#8221; for all domestic and foreign&#13;\ncinematic works. <\/p>\n\n<p>Namely, there are three categories of&#13;\nauthors\/rights holders of film works, namely:<br\/> &#8211; domestic&#13;\nauthors &#8211; members of UFUS AFA PROTECTION,<br\/> &#8211; domestic&#13;\nauthors who are not members of UFUS AFA&#13;\nPROTECTION<br\/> &#8211; and foreign authors.<\/p>\n\n<p><strong>Domestic&#13;\nauthors &#8211; members of UFUS AFA PROTECTION<\/strong><\/p>\n\n<p>Domestic authors -&#13;\nmembers of UFUS AFA PROTECTION exclusively&#13;\nassigned their rights to UFUA AFA PROTECTION, with&#13;\nthe permission to conclude contracts with users of&#13;\ncopyright works (operators) on the non-exclusive&#13;\nassignment of those rights on their behalf. <\/p>\n\n<p><strong>Domestic and foreign&#13;\nauthors who are not members<\/strong><\/p>\n\n<p>UFUS&#13;\nAFA PROTECTION protects the rights of both domestic&#13;\nand foreign authors who are not their members, given that&#13;\nthe legal assumption established in our law is that the&#13;\norganization has the authority to act on behalf of all&#13;\ndomestic and foreign copyright holders in regard to those&#13;\nrights and those types of subjects of protection that are&#13;\ncovered by their activity, i.e. their permit. <\/p>\n\n<p>This represents a&#13;\nso-called extended license, an institute which is generally&#13;\naccepted in the international regulation of collective&#13;\nprotection of copyright and related rights.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>About organization The Serbian Film Authors&#8217; Organization is a non-profit&#13; organization whose goal is the collective realization of&#13; property copyrights for film authors and other rights&#13; holders.
